Their chat soon veered into work talk, with Justice Kwenda referencing a recent case in Shona, “Ne case yembudzi iyoyi (With this goat case).”
This alluded to the high-profile fraud trial where he had, on 8 December 2025, sentenced businessmen Mike Chimombe and Moses Mpofu to prison over an US$88 million agriculture ministry goat supply scandal.
The clerk responded, “Yaa pange paipa, I hope tools down now.”
The judge replied, “..and tools in,” adding a “see no evil” monkey emoji.
She answered, “Kkk in where?”
The discovery came at a vulnerable time, just after the judge's ruling in the widely publicized goat tender fraud case had dominated headlines.
Sources say the clerk has told the JSC there was no physical relationship, emphasizing the messages stayed digital.
In his defense, Justice Kwenda argued the screenshots were unlawfully obtained, highlighting a breach of privacy rather than addressing the content directly.
The JSC, chaired by Chief Justice Luke Malaba, now weighs whether the flirtatious tone violates judicial conduct standards.
JSC spokesperson Daniel Nemukuyu declined to comment when contacted on 7 February 2026.
The complainant husband also chose silence hoping to shield his children from further public pain.
