A Delta State High Court in Kwale has sentenced 24 year old Ebinum Prosper to death by hanging for the murder of his classmate Ojieh Chibogu in Ugiliama Community nearly a decade ago.

The conviction came from Justice F Enemor of High Court No 2 Kwale on Monday March 2 2026 after finding the defendant guilty of murder beyond reasonable doubt.
Prosecution led by Mrs Catherine O Onoberhie Oberuomo, Assistant Director in the Delta State Ministry of Justice presented evidence that on June 29 2016 in Ugiliama Community Kwale, the defendant stabbed the deceased with a knife following a misunderstanding resulting in his death.
The case filed under Suit No HCK/89C/2022 State vs Ebinum Prosper originally began in Asaba but faced major disruption during the 2020 EndSARS protests when court documents and exhibits were destroyed in a fire incident at the address stage.
Following the establishment of the Kwale Criminal Division, the prosecution successfully applied for a trial de novo transfer back to Kwale where the crime originated using certified true copies from the Asaba High Court Registry to reconstruct the file.
After the prosecution closed its case, the defence took over one year to open and present its defence.
Justice Enemor in his judgment emphasized that the prosecution had successfully proved its case beyond reasonable doubt, leading to the conviction and mandatory death sentence by hanging for murder under Nigerian law.
